Photograph Policy

Requests for photographic and other reproduction services and the intended use of reproductions must be made in writing. Upon receiving a request, the Society will either mail an invoice or request additional information before invoicing the order. Prepayment is required on all jobs.

Please identify the image as completely as possible, including call number or database id (if known), as well as the intended use and number of copies to be published (provide a photocopy of the front and back page of image when possible, for visual reference.)

  • Fax all communications to the attention of the Coordinator for Rights and Reproductions at 215-732-2680.
  • Possession of a Society photograph does not constitute permission to use it.


The copyright law of the united States (Title 17, U.S. Code) governs the making of photocopies or other reproductions of copyrighted material. Under certain conditions specified in the law, libraries and archives are authorized to furnish photocopies or other reproductions of copyrighted works. One of these specified conditions is that the photocopy or reproduction is not to be "used for any purpose other than private study, scholarship, or research." If a user makes a request for, or later uses, a photocopy or reproduction for purposes in excess of "fair use," the user may be liable for copyright infringement. This institution reserves the right to refuse to accept a copying order if, in its judgement, fulfillment of the order would involve violation of the copyright law. The granting of permission to publish by the Society does not absolve users of materials from securing permission from copyright owners and payment of such additional fees as the owners may require if the Society does not own copyright or if the material is not in the public domain. Applicants assume all responsibility for questions of copyright and invasion of privacy that may arise in copying and in the use made of the photographic copy.

Rights Reserved to the Society

The Historical Society of Pennsylvania reserves the right to refuse any request and to impose such conditions as it may deem advisable in the best interests of the Society. The fees and permission are granted for one-time, exclusive use and for the number of copies specified on the agreement. The Society reserves the right to limit the number of photographic copies; to restrict the use of reproduction of rare and valuable materials; and to charge different fees than the ones published herein. Subsequent printings or editions such as book-club, paperback, electronic format, or international editions require further written permission and may require payment of additional fees. The details of use will be specified in a written permission release agreement drawn up between the party requesting use and The Historical Society of Pennsylvania. The Society retains copyright of its materials.

Conditions of Permission to Publish Agreement

Individuals and those signing on behalf of organizations, companies, corporations must agree to use the photographic copy only once and for the purpose listed in the permission to publish agreement "Statement of Intended Use." Use on an end paper, or dust jacket or as any advertisement constitutes a separate use and must be applied for in writing. Additionally, any subsequent editions and/or different languages, etc. constitute reuse and must be applied for in writing. There is a reuse fee.

Credit the Society in the following format: The Historical Society of Pennsylvania, followed by the identifying collection name if appropriate and the artist or photographer if known. With printed matter, it is preferred that the credit line appear on the same or facing page as the illustration or with "Sources of Illustrations." Each individual item must be credited. With films, video, and CD format use, credit with "Other Sources of Illustrations." In the manuals that accompany filmstrips, credit at the point where the illustration is discussed. With exhibitions, show credit within the exhibition area, preferably directly below or adjacent to the original copy. For Web use, credit should appear either adjacent to the image or in a "Sources of Illustrations" section and must include a "Link" or the Uniform Resource Locator for The Historical Society of Pennsylvania Web Page.

Send a complimentary copy (including CD-ROM) of any publication or reproduction using Society materials (images, artifacts, or transcripts from manuscript collections) to the Coordinator for Rights and Reproductions within 3 months of the publication date.

To indicate in the accompanying label or caption any and all changes or alterations that have been made to the original copy, including cropping, tinting, or detailing.

To not permit others to reproduce the photographic copy or any facsimile (including scanned copies) of it.

In authorizing the reproduction of works within its collections, The Historical Society of Pennsylvania does not surrender its own right to publish or to grant permission to others to do so.

Any exceptions or modifications to the above conditions will appear on, and be considered part of, the Society's letter of agreement.

Use Fees

Reproductions of materials from the collections of The Historical Society of Pennsylvania are provided under license agreement for purposes as indicated in writing by the user and agreed upon by the Society. Conditions governing their use are specified on a contractual agreement generated by the Society and to be signed by both the user and a representative of the Society. The Society reserves the right to require special fees for some forms of use. The prices listed herein are subject to change.

Permission to publish or to reproduce materials in The Historical Society of Pennsylvania's collection must be obtained in writing and in advance of publication (including print, electronic or digital formats) by applying to the Coordinator for Rights and Reproductions (CRR). Complete and exact citations are required for permission to be granted. All rights to publish are for non-exclusive use and are per use and per medium. Permission is granted for one-time use and for the number of copies specified on the agreement. Subsequent printings or editions such as book-club, paperback, electronic format, or international editions, constitute a reuse and require written permission and may require payment of additional fees.

Peer review scholarly journals are not subject to the reproduction/royalty fees, but they must obtain permission to publish materials from the Society's collection.

We are pleased to support the missions of non-profit organizations by providing reduced rates. Non-profit fees are applicable only to those organizations able to prove legal not-for-profit status by providing suitable documentation such as tax-exempt certificates or letters of identification.

Permission to publish the Society’s images on personal and educational web sites must be obtained in writing. User fees will apply.

Commercial fees are charged to corporations, partnerships, private businesses, and individuals. Non-profit rates are charged to non-profit corporations and government agencies.
